Intellectual Property (IP) and DMCA Compliance Policy

DEBEL (debel.app), operated by DEBEL 69 Sdn. Bhd. ("the Company," "we," "us," or "our"), respect the intellectual property rights of creators, educators, authors, and artists.

This Intellectual Property (IP) and DMCA Policy applies to our website, mobile applications, member dashboards, and all digital educational services provided through our marketplace. It outlines the procedures for reporting copyright infringement on user-generated course content, webinars, and educational articles hosted on our infrastructure. It is designed to comply with Section 512(c) of the Digital Millennium Copyright Act (DMCA) and Malaysian intellectual property frameworks, fulfilling regulatory security guidelines required by our payment processors, including Payment gateway.

  1. Ownership of Educational Content
  • Platform Content: All software code, UI designs, brand logos, layouts, and site copy found on debel.app are the exclusive property of DEBEL 69 Sdn. Bhd. and are protected under global copyright and trademark laws.
  • Provider Content Ownership: Tutors, content creators, and organizations who publish webinars, course curricula, video modules, or downloadables retain their original copyright. However, by publishing content on debel.app, providers grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that specific material to authorized paying students.
  1. Prohibition of Copyright Infringement

debel.app maintains a strict zero-tolerance policy regarding unauthorized use of proprietary educational material. Course creators are explicitly prohibited from uploading, selling, or distributing:

  • Pirated textbooks, exam preparation materials, or third-party academic curricula.
  • Unlicensed premium photography, slide decks, or graphic assets.
  • Video and audio recordings owned by other platforms or institutions without certified explicit written consent.
  1. DMCA Takedown Notice Procedure

If you are a copyright owner or a designated legal agent who believes that material hosted on debel.app infringes upon your exclusive intellectual property rights, you may submit a formal written DMCA Takedown Notice.

To be processed under DMCA Safe Harbor requirements, your notice must be sent via email to our Designated Copyright Agent and contain the following mandatory criteria:

  1. Contact Details: your physical or electronic signature, legal name, physical address, active telephone number, and professional email address.
  2. Identification of the Infringed Work: A clear description of the original copyrighted work you claim has been compromised.
  3. Location of Infringing Material: The exact URLs or page links on debel.app containing the disputed material to help our compliance team locate it quickly.
  4. Good Faith Assertion: An explicit statement that you have a good faith belief that the disputed use of the copyrighted material is not authorized by the owner, its legal agent, or the law.
  5. Perjury Statement: A declaration, under penalty of perjury, that the details provided in your notice are fully accurate, and that you are the lawful copyright holder or authorized to act on their behalf.

  1. Counter-Notification Procedure

If a tutor or provider believes their course content was removed or disabled by mistake or misidentification, they have the right to file a DMCA Counter-Notification to dispute the takedown.

  • The provider's physical signature and full contact information.
  • Identification of the specific material that was removed and its prior location URL.
  • A statement made under penalty of perjury that the provider has a good faith belief that the material was removed as a result of mistake or misidentification.
  • A statement consenting to local jurisdiction for the resolution of the dispute.

Upon receipt of a valid counter-notice, debel.app will forward a copy to the original complaining party. If the copyright owner does not file a court action seeking a restraining order within 10 to 14 business days, we reserve the right to reinstate the disabled content at our discretion.

  1. Repeat Infringer Policy

To protect our platform's processing infrastructure, debel.app actively enforces a strict Repeat Infringer Policy. In accordance with DMCA requirements, any registered tutor, speaker, or partner organization that amasses two or more verified, non-contested copyright complaints will have their provider account permanently terminated. All active listings will be removed, and remaining platform balances may be temporarily frozen pending full legal and financial review.

Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material on our site is infringing a copyright can be held liable for statutory damages and legal fees. Do not submit a false takedown request if you are unsure if you hold the legal copyright.
